These terms apply when you order a website from WebsiteBuilders (operated by Almacorp Pty Ltd, Australia, "we") through thewebsitebuilders.co. By placing an order you agree to them.
We design, build, host and maintain a website for your business based on the answers you give in our quiz and the changes you ask for afterwards. The plan includes the design and build, hosting with SSL, unlimited text, photo, price and hours edits, and ongoing care. Larger changes such as new pages or new features are included where they are reasonable for a small business site; we will tell you first if a request falls outside the plan.
The plan is billed monthly in US dollars by card through Stripe. The first month is charged when you order; each following month is charged on the same day. Promotional rates advertised at the time you order stay yours for as long as your plan stays active. Prices exclude any taxes that apply in your country. If a payment fails we retry and email you; if it is still unpaid after 14 days we may take the site offline until it is settled.
A first draft is usually ready within 48 hours and most sites go live within 7 days of your order, once we have what we need from you. Timeframes are estimates, not guarantees.
You must have the right to use the text, photos, logos and other material you give us, and it must not be unlawful, misleading or infringe anyone's rights. You are responsible for the accuracy of your prices, claims and legal notices on your site.
You own your content, your domain name and the finished design of your site. We own the tools, code libraries and templates we use to build and run it, and may reuse them for other customers. If you cancel we give you a copy of your site files on request.
We connect a domain you already own, or register one in your name at cost. Renewal fees for domains are yours.
You can cancel at any time by emailing us. There is no lock-in contract. Your site stays live until the end of the period you have paid for and no further payments are taken. Refunds are covered by our Refund policy.
Our money-back guarantee is described in the Refund policy. Beyond that guarantee, and to the extent the law allows, we are not liable for lost profits, lost business or indirect loss arising from the site or from downtime, and our total liability to you is limited to the amounts you paid us in the 3 months before the claim. Nothing in these terms removes rights you have under the Australian Consumer Law or similar consumer laws that cannot be excluded.
We may decline or end service for sites that are unlawful, deceptive, adult, gambling or that harm others, with a pro-rata refund of any unused period.

We may update these terms; the current version is always on this page. Material changes are emailed to active customers 14 days before they apply.
These terms are governed by the laws of New South Wales, Australia.
